The murder trial for popular Dancehall artiste Vybz kartel and 4(four) other co-accused in the killing of Clive ‘Lizard’ Williams resumes today Wednesday February 19, 2014 in the Home Circuit Court. Downtown, Kingston.
State prosecutor, Jeremy Taylor, today asked jurors at the Vybz Kartel murder trial to question the artiste’s “good character” after revelations that the entertainer gave the deceased guns to secure.
Taylor asked the jurors to consider the matter as he continued his submissions in the murder trial which also involves four co-accused.
The prosecutor told the 11-member jury that the Crown’s case was based on circumstantial evidence and common design.
Common design is when one or more persons come together to commit an offence.
Taylor asked the jurors to reject the address by Kartel’s lawyer that they were in a moral dilemma based on the evidence led by Crown.
He told them to approach the case with balance.
Taylor also said the jurors should reject Tavares-Finson’s plea that they should put themselves in the shoes of the accused men.
He told them that they were not in court to wear anyone’s shoes but their own.
According to Taylor, the jurors should use logic and reason and come to a true verdict and not speculate.
Taylor also addressed the claim of good character by Kartel and his co-accused Shawn Campbell, otherwise Shawn Storm, in their defense.
He told the jurors they heard evidence that the murder victim had a matter in the Gun Court for which he was on bail and that he had secured a gun on the entertainer’s behalf.
“They were locking gun on behalf of Palmer, so where is Kartel’s good character?” asked the prosecutor.
He said the prosecution witness had told them that he was a member of Gaza who secured guns on behalf of Kartel.
The prosecutor also said Kartel’s sister gave good character evidence but the jurors are to remember that there is loyalty in blood.
He told the jurors to consider that in all of Kartel’s 38 years, he could not find someone outside of his family to speak to his good character.
He also said no member of Gaza has come to speak on his behalf.
Gaza is the name of a group formed by the entertainer.
Justice Lennox Campbell this morning summoned a senior policeman into the courtroom and reminded him that Jamaicans have a legal right to access the court.
It followed complaints from lead defence lawyer Tom Tavares-Finson that family members of the accused men have been prevented from coming to court.
This morning, the police implemented several traffic changes in the areas surrounding the Supreme Court building on King Street.
As a result, some members of the public were barred from accessing the court building.
When Tavares-Finson raised the concern this morning the judge said he did not know the intelligence the police were working with.
He also suggested that the lawyer speaks to the police to ascertain further information.
However, this afternoon, the judge called a senior policeman into the courtroom about the issue.
The police did not offer an explanation.
However, the judge told the policeman that the security forces must be reminded that Jamaicans have a right to the court unless they have reasons that someone would interfere with its smooth running.
